1. Purpose

These General Terms and Conditions of Purchase govern the acquisition of products through the online store of NIBO, managed by Wear and Care S.L., accessible at www.nibowear.com.
The purchase of any product implies full and unconditional acceptance of these Conditions, as well as of the Privacy Policy and Cookie Policy.

2. Purchase Process

The online purchase process is carried out in the following steps:

  1. Selection of the product (model, size, colour).

  2. Validation of the cart and entry of shipping/billing details.

  3. Selection of the payment method.

  4. Order confirmation.

Once the purchase has been completed, the customer will receive an email containing the order number and a summary of the transaction, which constitutes the formalisation of the electronic contract in accordance with Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce (LSSI-CE).

3. Prices and Taxes

All prices include the Value Added Tax (VAT) applicable under current legislation.
Shipping costs will be shown separately before finalising the purchase.
In the event of a typographical error in the displayed price, Wear and Care S.L. reserves the right to cancel the order after notifying the customer.

4. Payment

The customer may make payment through the secure payment gateways enabled on the website: credit/debit card (Visa, Mastercard) and PayPal.
All payment transactions are subject to Strong Customer Authentication (SCA) in accordance with Directive (EU) 2015/2366 on payment services (PSD2) and Royal Decree-Law 19/2018, ensuring the security of electronic transactions.

5. Shipping and Delivery

Orders are prepared and shipped within an estimated period of 24 to 72 working hours after payment confirmation.
Delivery times depend on the destination: typically 2 to 5 working days within mainland Spain. For the Balearic and Canary Islands, Ceuta, Melilla, and other EU countries, delivery times may be longer and will be indicated during the purchase process.

In the event of delay, the customer will be informed and may choose to maintain the order or cancel it with the corresponding refund.
Wear and Care S.L. is not responsible for delays beyond its control (logistics, customs, etc.).

6. Right of Withdrawal

The customer has 14 calendar days from receipt of the product to withdraw from the contract without the need to justify the decision, in accordance with Royal Legislative Decree 1/2007, of 16 November, approving the consolidated text of the General Law for the Defence of Consumers and Users.

To exercise this right, the customer may send an email to laura@nibowear.com or use the withdrawal form included at the end of this document.
Return shipping costs will be borne by the customer, except in the case of error or defective product.

The right of withdrawal shall not apply to products made to the consumer’s specifications or clearly personalised (Article 103 of Royal Legislative Decree 1/2007).

7. Returns Policy

To process a return, the customer must contact customer service, indicating the order number and reason for the return.
The product must be returned in its original condition, unused, with complete packaging, labels and accessories. Once received and verified, Wear and Care S.L. will refund the corresponding amount within a maximum of 14 calendar days.

8. Warranty

All products marketed by Wear and Care S.L. carry a 2-year legal warranty of conformity, as established in Articles 114 et seq. of Royal Legislative Decree 1/2007.
This warranty covers manufacturing defects but not wear and tear or improper use of the product.

9. Liability

Wear and Care S.L. shall not be liable for damage arising from misuse, improper handling, or failure to follow the care and maintenance instructions of the product.

10. Intellectual Property and Website Use

All content on the website (texts, images, logos, trademarks, designs, software, source code, etc.) is the exclusive property of Wear and Care S.L. or authorised third parties, and is protected under intellectual and industrial property laws.
Total or partial reproduction, distribution or public communication of the contents without express authorisation of the owner is strictly prohibited.

Messages will be answered within a maximum of 48 working hours.

Customers may also use formal dispute resolution channels such as the European Online Dispute Resolution (ODR) platform [https://ec.europa.eu/consumers/odr] or the Consumer Arbitration Board, providing an extrajudicial method of resolving disputes.

12. Applicable Law and Jurisdiction

These General Terms and Conditions of Purchase are governed by Spanish law, particularly by:

  • Royal Legislative Decree 1/2007 (General Law for the Defence of Consumers and Users).

  • Law 34/2002 (Information Society Services and Electronic Commerce – LSSI-CE).

  • Regulation (EU) 2016/679 (General Data Protection Regulation – GDPR).

  • Organic Law 3/2018 (Data Protection and Digital Rights).

  • Directive (EU) 2015/2366 (PSD2) and Royal Decree-Law 19/2018 (payment services).

In case of conflict or dispute, the customer may choose to submit to the courts of their domicile or, failing that, to the courts of Barcelona (Spain).
